INFORMATION ABOUT THE PROCESSING OF PERSONAL DATA pursuant to EU Regulation 2016/679 and Italian Legislative Decree No. 196/03

APPLICANTS/COURSE PUPILS

In relation to the processing of personal data supplied for the enrolment/ selection/ attendance of courses, we hereby inform you that:

1. Data controller and data protection officer (DPO)

The data controller is Fondazione Busoni-Mahler Foundation, with registered office in Bolzano in Vicolo Gumer No. 7 (hereinafter referred to as “the Foundation”).

2. Types of data subject to the processing, purposes and legal basis for the processing

2.1 The following personal data of applicants/course pupils are collected and processed: a) personal data of a common nature (name and surname, residence, general data, contact details, telephone number, e-mail address); b) data of a special nature since they may reveal one’s racial or ethnic background (citizenship, identification documents, visas, residence permits); c) data about performances and artistic/professional characteristics (curriculum vitae, professional career, videos of performances, if any); d) photos, images, video recordings, photos on stage, family name and stage name and any other information/biographical information about the applicants/pupils for the purposes of internal documentation of the Foundation and artistic interest.

The data above are collected and processed for the following purposes: a) enrolment/selection/attendance of courses/participation in competitions and requests for information about the same; b) fulfilment of legislative and regulatory obligations and of tax and accounting legislative obligations as well as for administrative purposes (e.g. payments, reimbursements and invoicing); c) sending of institutional communication and information material about the courses; d) use as internal documentation of the Foundation and artistic interest.

The legal basis for the processing of data for the purposes stated above is therefore: fulfilment of contract/legal obligations and legitimate interest for item 2.1. letter d).

2.2 With the express prior consent of the data subject, the following may also be collected and processed: photos, images, video recordings, photos on stage, family name and stage name and any other information/biographical information about the applicants/pupils for promotional and advertising purposes of the Foundation and of its activities, in any format and form (e.g. paper, cd, digital media) and by any means of dissemination (e.g. brochure, posters of events, website, social network) as well as works of art, if any, created during the classes and the free-of charge exhibitions included in the programme of the courses of the Gustav Mahler Academy and any related right for the dissemination by any technical means (film, radio, television, magnetic tape or any other magnetic support), in any form and manner, entirely or partially, by air, cable, satellite, free to air or encoded, in Italy and abroad, without space or time limitations, also with reference to the number of transmissions and possibly with reductions and/or adaptations. In this case the legal basis is the free express consent of the data subject.

2.3 With the express prior consent of the data subject, the contact details of applicants/pupils may be used to send promotional material of the Foundation, information about courses and events and newsletters. In this case the legal basis is the free express consent of the data subject.

3. Disclosure of data to a third party – Recipients of the data

3.1. The Foundation may communicate the data processed for the purposes under item 2.1 limited to the data that are strictly necessary for the management of the application/attendance of courses and related legal obligations, to: i) internal and external subjects who cooperate for the management of the course, teachers, art director; ii) professional firms for accounting, administrative and legal activities; iii) firm managing the website for enrolment; iv) suppliers of services, if any, to applicants/pupils; v) photographers and other suppliers of related services; vi) banks, insurance companies and credit institutes.

3.2. The Foundation may communicate and disseminate data processed for the purposes under item 2.2, related to photos, images, videos etc. of applicants/pupils for promotional/advertising purposes to: i) internal subjects and external subjects/companies managing the website, social media and making promotional/advertising material and communication companies; ii) journalists or information organizations.

3.3. The Foundation may communicate the contact details for the purposes under item 2.3 to: i) internal subjects and external subjects/companies in charge of sending and promoting promotional/advertising material and communication companies.

4. Data transfer to third countries

Data are not directly transferred by the data controller to third countries since they are processed in Italy. Nevertheless, in case of transfer of data to third countries, their transfer shall occur in compliance with the current applicable rules about data transfer to third countries (Article 44 and following articles Reg. 2016/679).

5. Method of processing, duration and criteria of data storage

The data shall be processed in printed and digital formats in compliance with applicable laws.

Data shall be processed by the data controller for the time necessary for the achievement of the goals(s) indicated above and, upon their completion, for the additional time prescribed by the law for the storage of contracts and administrative data and/or for defence before the courts (ten years since the latest usage and/or event which interrupted the limitation period). The Foundation may, however, store some data (e.g. information, images, videos of performances etc.) even afterwards for educational purposes, for purposes of artistic interest and of public information.

6. Supply of data

The supply of data under item 2.1 is mandatory for the selection/enrolment/attendance of the course and for the achievement of the purposes stated above. Failure to supply the data entails therefore that those purposes cannot be achieved.

The supply of data under item 2.2. (images/videos etc.) and 2.3. (contact details) for promotional /advertising purposes and for the sending/receiving of information and communication is merely optional and subject to the free consent of the data subject. Failure to supply the data entails that the purposes indicated above cannot be pursued.

7. Rights of the data subject, withdrawal of consent and complaint with a supervisory authority

The data subject has the right, at any moment, to request access, rectification or erasure of personal data, their limitation, to object to their processing and to exercise the right to data portability.

In any case, the data subject has the right to withdraw the consent to data processing at any time, without affecting the lawfulness of the processing based on consent before its withdrawal.

Furthermore, in case of alleged infringement and if requirements are met, the data subject has the right to lodge a complaint with a supervisory authority of data processing in the Member State of his or her habitual residence or in the EU Member State where he or she works or where the alleged infringement took place.

8. Profiling and automated decision-making

Processing of data is not performed by means of automated decision-making processes (e.g. profiling).

9. Contacts and requests

The data subject can send a request to the e-mail address info@mahler.academy or write to dpo@busoni-mahler.com to withdraw the consent given to the processing of data and to exercise his or her rights (access, rectification, erasure, limitation, opposition, portability) about data processing, to learn and receive information also about the list and names of external subjects to whom data are communicated, the possible transfer of data to non-EU states, mechanisms and protection of data transfer pursuant to Article 44 and following articles of GDPR and any other communication.

CONSENT TO THE PROCESSING OF DATA FOR APPLICATIONS FOR ENROLMENT-ATTENDANCE OF COURSES

I have read and understood the information about the processing of personal data – applicants-pupils and hereby give my consent to the processing of personal data and special data under item 2.1. for the purposes and duration specified in the information, in relation to the completion and management of the enrolment-attendance of courses and for internal uses.

I have read and understood the information about the processing of personal data – applicants-pupils and hereby give my consent to the processing and free use of data under item 2.2. (images, videos, photos, video recordings, photos on stage, family name and stage name and any other information/biographical information) as well as works of art, if any, created during the free-of charge exhibitions included in the programme of the courses of the Gustav Mahler Academy and any related right for the dissemination by any technical means (film, radio, television, magnetic tape or any other magnetic support), in any form and manner, entirely or partially, by air, cable, satellite, free to air or encoded, in Italy and abroad, without space or time limitations, also with reference to the number of transmissions and possibly with reductions and/or adaptations for promotional and advertising purposes of the Foundation and of its activities, in any format and form (e.g. paper, cd, digital media) and by any means of dissemination (e.g. brochure, posters of events, website, social network), without space or time limitations and free of charge and I authorize their free use.

I have read and understood the information about the processing of personal data – applicants-pupils and hereby give my consent to the processing of data under item 2.3. (e-mail, telephone, contact details) for the sending of informative communication and promotional-advertising communication about courses and events of the Foundation and of its activities, in any form or format.
